Unlawful visa requests

You are considered to be unlawful if your temporary visa (work, student or visitor) expires while you are in New Zealand.

Unlawful individuals have limited options available and cannot apply for a further visa. Instead, they may request a visa under section 61 of the Immigration Act and provide compelling rationale to support the grant of such a visa.

In this situation, Immigration New Zealand staff utilise their absolute discretion will decide to either approve or decline your request, depending on how compelling your submission is.
